By accessing or using The Best Wine Choice mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Description of Service

The Best Wine Choice provides AI-powered wine recommendations, pairing suggestions, and tasting notes through a mobile application. Our service includes:

• Wine bottle scanning and recognition
• AI-generated wine recommendations
• Expert pairing suggestions
• Detailed tasting notes
• Personalized wine recommendations

3. Subscription Terms

3.1 Subscription Plans

We offer two auto-renewable subscription options:

• Monthly Premium: $9.99/month - Unlimited access with monthly billing
• Annual Premium: $99.99/year - Unlimited access with annual billing (save 17% compared to monthly)

3.2 Auto-Renewal

Your subscription will automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.

3.3 Free Trial

If we offer a free trial period, you will be charged the subscription fee at the end of the trial period unless you cancel before the trial ends. Free trials are only available once per user.

3.4 Cancellation

You may cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period. No refunds will be provided for partial subscription periods.

3.5 Price Changes

We reserve the right to change subscription prices at any time. Price changes will be communicated to you in advance and will take effect at your next renewal date.

4. User Accounts

4.1 Account Creation

To use certain features of the App, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account

4.2 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent, abusive, or illegal activities.

5. Acceptable Use

You agree NOT to:

• Use the App for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the App's functionality
• Copy, modify, or distribute our content without permission
• Use automated systems (bots, scrapers) to access the App
• Reverse engineer or decompile the App
• Share your account credentials with others

6. Intellectual Property

All content, features, and functionality of the App, including but not limited to text, graphics, logos, images, and software, are owned by The Best Wine Choice and protected by copyright, trademark, and other intellectual property laws.

7. AI-Generated Content

Our wine recommendations and tasting notes are generated using artificial intelligence. While we strive for accuracy:

• Recommendations are for informational purposes only
• We do not guarantee the accuracy of all AI-generated content
• You should verify important information independently
• We are not responsible for decisions made based on our recommendations

8. Age Restrictions

You must be of legal drinking age in your jurisdiction to use this App. By using the App, you represent that you meet this age requirement. We do not knowingly collect information from users under the legal drinking age.

9. Disclaimers

9.1 No Warranty

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES.

9.2 Health and Safety

We are not responsible for any health issues, allergic reactions, or other consequences resulting from consuming wine based on our recommendations. Always drink responsibly and consult with healthcare professionals regarding dietary restrictions.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE BEST WINE CHOICE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF YOUR USE OF THE APP.

11. Indemnification

You agree to indemnify and hold harmless The Best Wine Choice from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App or violation of these Terms.

12. Third-Party Services

The App may integrate with third-party services (such as payment processors, analytics providers). Your use of these services is subject to their respective terms and privacy policies.

13. Apple App Store Terms

If you download the App from the Apple App Store, you acknowledge and agree that:

• These Terms are between you and The Best Wine Choice, not Apple
• Apple has no obligation to provide support for the App
• Apple is not responsible for any claims related to the App
• You must comply with Apple's App Store Terms of Service

14. Refund Policy

All subscription purchases are processed through the Apple App Store. Refund requests must be submitted directly to Apple through your Apple ID account. We do not have access to process refunds directly.

Apple's refund policy applies to all purchases. Generally, subscriptions are non-refundable, but you may request a refund from Apple within their specified timeframe.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes through the App or via email. Your continued use of the App after changes constitutes acceptance of the updated Terms.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

17. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except where prohibited by law.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and The Best Wine Choice regarding the use of the App.
