Terms of Service

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you and Converge AI ("we," "us," "our"). By accessing or using the App, you confirm that you are at least 13 years of age and capable of entering into a binding agreement.

2. Description of Service

Converge AI is a group activity decision-making platform that uses artificial intelligence to generate activity suggestions based on member preferences. The App allows users to create groups, set preferences, receive AI-powered suggestions, vote on activities, and reach group decisions.

3. User Accounts

• You may create an account using a display name. The App uses anonymous authentication.
• You are responsible for maintaining the security of your device and account.
• You agree to provide accurate information when using the App.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscription Plans

• Free Tier: Limited to 2 groups and 3 AI suggestions per session.
• Converge Pro: Unlimited groups, 35 AI suggestions per session, priority AI, group analytics, custom categories, session history, and export decisions.
• Subscriptions are billed through Apple's App Store. By subscribing, you agree to Apple's terms of service for in-app purchases.
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
• You can manage or cancel your subscription in your device's Settings > Apple ID > Subscriptions.

5. Acceptable Use

You agree not to:

• Use the App for any illegal or unauthorized purpose.
• Attempt to interfere with or disrupt the App's infrastructure.
• Upload or transmit harmful content, including malware or spam.
• Impersonate another person or entity.
• Reverse-engineer, decompile, or disassemble any part of the App.
• Use automated systems or bots to access the App.

6. AI-Generated Content

• Activity suggestions are generated by artificial intelligence and may not always be accurate or suitable.
• We do not guarantee the accuracy, availability, or safety of suggested venues or activities.
• You should independently verify venue details (hours, pricing, safety) before visiting.
• We are not liable for any outcomes resulting from following AI-generated suggestions.

7. Intellectual Property

All content, design, code, and branding of Converge AI are owned by us or our licensors. You may not copy, modify, or distribute any part of the App without our prior written consent.

8. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

9. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the App will be uninterrupted, secure, or error-free. We disclaim all liability for any damages arising from your use of the App.

10. Limitation of Liability

To the maximum extent permitted by law, Converge AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or profits, arising from your use of the App.

11. Indemnification

You agree to indemnify and hold harmless Converge AI, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes through the App or by updating the "Last updated" date. Continued use of the App after changes constitutes acceptance of the new Terms.

13. Termination

We may terminate or suspend your access to the App at any time, with or without cause, with or without notice. Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination will do so.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to conflict of law principles.
